Splinter Cell: Conviction Issues

I have background programs closed (cpu usage: 0%, Memory 23%)
The game lags a lot, however I feel it's an issue with my mouse. When I don't move my mouse enemy ai move smoothly, lighting looks fine and everything runs at a smooth fps.
However when I start to move my mouse the game lags a lot, I've disabled AA and AF, and enabled mousesmoothing.
My game is fully updated to 1.03.
If you know anything about how to solve this problem please post! Otherwise--please don't tell me to search google, I've obviously explored everything before posting on this forum.
